Terms of service
I. General Provisions
These Terms (hereinafter – the “Terms”) govern the legal relations between the parties involved in the sales agreement, namely:
The Seller – FOP Kuzhym Yuliia Ihorivna
address: 3 Zinkivska St., “Kyiv” Shopping Mall, Poltava, Ukraine
(hereinafter also referred to as the “Seller,” “Store,” “POKKOT Beauty”),
and The Buyer – an individual who has placed an order and purchased goods from the Seller through the online store located at https://www.pokkot.com
(hereinafter – the “Buyer,” “Client”).
The Buyer is any legally capable individual who accepts these Terms and places an order via the website.
If the Buyer is an individual who does not act within the scope of entrepreneurial activity, they are considered a consumer under the Law of Ukraine “On Consumer Rights Protection.”
For all relations not governed by these Terms, the following legal acts apply:

the Civil Code of Ukraine

the Law of Ukraine “On Consumer Rights Protection”

the Law of Ukraine “On Electronic Commerce”

the Law of Ukraine “On Personal Data Protection”
-
other relevant regulatory acts of Ukraine.
If the Buyer is a business entity (entrepreneur or legal entity) and provides business details (EDRPOU / Tax ID, company name, etc.), they act as an entrepreneur, and corresponding commercial regulations apply.
By submitting an order through the website, the Buyer confirms that they have read and fully agree to these Terms.
II. Security and Protection of Information
When placing an order, the Buyer provides the following minimum required data:

first and last name / company or sole proprietor name (if applicable);

delivery address;
-
business details for document issuance (if applicable);

email;
-
phone number.
This information is necessary to identify the Buyer, process the order, deliver the goods, and communicate with the Buyer.
The procedure for processing personal data is detailed in the Privacy Policy available on the website. By placing an order, the Buyer confirms that they have read the Privacy Policy and consent to the processing of their personal data.
In case of a complaint or claim, the Seller may request: name, surname, address, phone number, email, and order details. The data will be processed solely for the purpose of reviewing the claim, in accordance with the Law of Ukraine “On Personal Data Protection.”
III. Conclusion of the Sales Contract
The sales contract between the Seller and the Buyer is concluded electronically as a distance contract under the Law of Ukraine “On Electronic Commerce.”
Contract formation process:

The Buyer forms an order on the website (adds products to the cart, fills in required information, selects delivery and payment method, and confirms the order).
This constitutes an offer to conclude a contract.

The Seller confirms the order by sending an email, message, or SMS to the Buyer.
This constitutes acceptance.
From the moment the order is confirmed, the sales contract is considered concluded.
The Seller undertakes to deliver the goods in the quantity, assortment and quality corresponding to the description on the website, and the Buyer undertakes to accept the goods and pay for them.
Ownership of the goods transfers to the Buyer upon full payment unless stated otherwise.
The risk of accidental loss or damage passes to the Buyer when the goods are handed over to the delivery service or directly to the Buyer (depending on the chosen delivery method).
IV. Price and Payment Terms
The price of goods is indicated on the website at the moment of placing the order. All prices are shown in UAH (Ukrainian hryvnia) and include taxes where applicable.
The Buyer can review the full cost of the order (including delivery, if applicable) before confirming the order.
Available payment methods (as indicated on the website):

online payment by bank card;

cash on delivery (if available);

other methods available at checkout.
The goods remain the property of the Seller until full payment is received.
V. Delivery of Goods
Delivery conditions depend on the chosen method and the Seller's logistics partner.
Key provisions:

delivery is made to the address specified by the Buyer or to the carrier’s pickup point;

estimated delivery times, cost, and available methods are shown during checkout;
-
the Buyer must timely collect the shipment.
The Seller’s obligation is considered fulfilled when the goods are handed over to the delivery service or directly to the Buyer. From this moment on, the risk of loss or damage passes to the Buyer.
Delivery may:

be included in a promotional offer;
-
be paid by the Buyer additionally.
The exact conditions are always displayed at checkout.
VI. Return of Goods and Contract Withdrawal
1. GOODS OF PROPER QUALITY
Cosmetic products and personal hygiene items, according to Ukrainian law, cannot be returned or exchanged if they are of proper quality, have been opened, or used.
Given the nature of the products (cosmetics, skincare, hygiene items), the Seller does not accept returns of goods of proper quality, even if they do not meet the Buyer’s individual expectations (scent, texture, skin reaction, etc.).
2. GOODS OF IMPROPER QUALITY
If defects are discovered (manufacturing defect, damaged packaging before receipt, leakage, damage during transport, etc.), the Buyer may submit a claim under the Law of Ukraine “On Consumer Rights Protection” requesting:

replacement with an identical item;
-
proportional price reduction;
-
defect correction (if possible) or a refund.
To submit a request, the Buyer must:
-

-
provide order number, description of the issue, and photos/videos of defects;
-
return the goods upon Seller’s request (if required for inspection).
A decision on the claim is made within a reasonable time in accordance with the law.
VII. Warranty and Liability for Product Defects
Warranty conditions are determined by:

Ukrainian legislation;
-
manufacturer’s warranty terms (if available for the specific product).
The standard minimum warranty for industrial goods is 24 months, but for cosmetics and skincare products, the expiration date indicated on the packaging is the key criterion.
A product is considered defective if it:
-
does not match the stated characteristics;
-
has unagreed damages;
-
is unusable for its intended purpose.
Individual skin reactions (allergies, irritation) are not considered defects. Buyers with sensitive skin should consult a dermatologist and carefully review the product ingredients.
Images on the website are for illustration purposes and may slightly differ from the actual product (updated packaging design, etc.).
VIII. Procedure for Reviewing Claims
If defects are identified, the Buyer may submit a claim (complaint) to:

The claim should preferably include:

problem description;

photos/videos of the product and packaging.
The Seller reviews claims within a reasonable timeframe and informs the Buyer of the result and the next steps (replacement, compensation, discount, etc.).
If the claim is approved:

the Seller may refund the cost of the product;
-
or replace the product;
-
or offer alternative compensation.
If product return is required, return shipping costs may be compensated if the defect is confirmed.
IX. Dispute Resolution
All disputes between the Seller and Buyer should be resolved, whenever possible, through negotiations and communication via email:

If no resolution is reached, the dispute may be submitted to:

the relevant regulatory authorities of Ukraine (consumer protection authorities),

or the courts of Ukraine in accordance with applicable law.
X. Final Provisions
By placing an order on https://www.pokkot.com, the Buyer confirms that they:

have read these Terms;
-
fully agree with them;
-
understand their rights and obligations as a Buyer.
The Seller reserves the right to amend these Terms. The current version is always published on the website and becomes effective from the moment it is posted.
